ARC
Written approval from the Architectural Review Committee must be given for painting of any exterior surfaces; new roofs; new windows; new front doors, moldings or casings; gutters; soffits; driveways painting or pavers; lanai pavers or resurfacing; landscaping or any other elements of the structure which in any way materially changes the exterior appearance.
 
The Architectural Review Committee for the Heritage Palms Master Association generally meets on the last Thursday of the month at 4:00 p.m. in the Activity Center- Conference Room.
 
For an application to be part of the ARC’s agenda for a given month, the application must be received in HP Administrative Office no later than 12:00 p.m. on the Friday prior to the regular meeting date.    Submit comments here.

  • A separate application must be submitted for each project.
  • All Applications must be signed and dated by the Applicant/Owner.
  • All projects must include current copies of the contractor’s local or state licenses and certificates of the contractor’s insurance for liability and workman’s compensation clearly showing the date(s) of such validity through the completion of the project.

  • All projects must include:  A minimum of two 4” x 6” photographs of existing conditions to better describe the project(s) for the ARC’s review.  Additional photographs are acceptable as necessary to better explain the intent of your project(s).  
  • All Applications must have neighborhood Association President’s signature for the ARC Committee review the application at its regular meetings.
  • Notification by Applicant to Neighbor(s) of Pending Project Form: In accordance with Section 6.3 (A) of the By Laws, notification is necessary to advise neighbor(s) of the pending project.  The notification can be accomplished by presenting the notification by applicant to neighbor(s) form to the neighbor(s) for their signature, sending a certified letter to the neighbor(s) with a Return Receipt Requested as proof, or receiving an email or other letter from the neighbor that they have been notified.  An adjacent neighbor means on either side of Villas and Single Family units and also above and below for Verandas and Terraces.  The Form also advises Neighbor(s) how they can present concerns to the project.
Architectural Review Compliance Violations (Sections 6 and 10 of the Declarations and Covenants) are a serious matter and will be addressed using the following rules of enforcement.  These penalties range from suspension of gate passes during season, while the violator is here, suspension of Golf and Tennis play and Fines.

Types of violations
  • Work is performed without an ARC application and approval.
  • Work is completed by an owner that is outside the ARC Guidelines without a completed ARC application and approval.
  • Work not performed as stated on the application
  • Work not performed within the time frame and schedule stated.
  • Failure to submit project changes to an approved application.  Submission to the ARC must be done before changes are made.
  • Failure to follow the Guidelines related to tree removal and replacement.
  • Improper deployment of Hurricane Shutters.
  • Failure to follow required Hurricane Shutter deployment periods, specifically, when they can be installed and when they must be taken down.
The owner will be notified of the violation by letter.  Following 14 days, non-compliance will result in gate privileges being removed, while the owner is here.  Further noncompliance will result in penalties which will include Loss of Golf and Tennis privileges and fines of $100 per day up to $5000 until the application is approved.

In the event that the violator is an HOA or Neighborhood Association, the penalty will be a fine.

Privileges will be re-established following an application submission and approval.  Privileges may be removed a second time if the ARC does not approve the application at the next regular meeting.  

Rectification of a violation will be:
  • Submission of a completed/amended ARC application no later than 14 days from the date of the notice.
  • The owner may be required to restore the property to the condition existing prior to the violation.

Appeal Process.  See Section 10 of the declaration for more info. A unit owner is allowed the opportunity to appeal a violation within 14 days and request a hearing before a judicial committee appointed by the Board of Directors.
